R40 with random mouse problems

Got a r40 recently and installed xp twice and it ends up with a problem where the right click has a fit and the mouse will stop working until I turn off the laptop. I have no ideia if its a driver thing or a hardware thing? Now Im basicly just waiting to get the recovery partion here because mine didnt come with a hard drive. But what can i do with the mouse?
